I. Scope of Application

1. These General Terms and Conditions (GTC) apply to all contracts concluded via the online shop at goelles.at between Gölles GmbH and customers who are consumers within the meaning of the Consumer Protection Act and have their residence or habitual abode in Austria or Germany.

2. Orders from businesses are not processed via the online shop. Separate conditions apply to trade and catering partners, which are agreed upon individually.

3. By placing an order, the customer acknowledges these GTC.

4. Deviating terms and conditions of the customer do not become part of the contract unless Gölles GmbH expressly agrees to them in writing.

5. Visits via shop.goelles.at are redirected to goelles.at. These GTC apply to both addresses.

II. Contract Language

The contract shall be concluded in German.

III. Conclusion of Contract

1. The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to the customer to submit an offer themselves.

2. The customer places the desired goods into the "shopping cart" and proceeds through the ordering process via "Checkout." There, they enter the delivery and billing address and select the shipping and payment method. Before submission, all details are summarized in an overview. The customer can check and correct their entries there. By clicking on the final "Buy Now" button, the customer submits a binding purchase offer.

3. Upon receipt of the order, Gölles GmbH sends a confirmation e-mail to the specified address, in which the receipt and content of the order are reproduced. This confirmation does not constitute acceptance of the offer. The contract is concluded with the shipping confirmation or the delivery of the goods. If Gölles GmbH declines to conclude the contract, this will be communicated immediately by e-mail.

IV. Storage of the Contract Text

Gölles GmbH stores the contract text. Customers with a customer account can view their orders at any time in their account. Independently of this, the order confirmation and these GTC are sent to the specified e-mail address.

V. Right of Withdrawal

1. Consumers have the right to withdraw from this contract within fourteen days without giving any reason. The period begins on the day on which the customer or a third party named by them, who is not the carrier, has taken possession of the goods. In the case of an order with separate deliveries, the period begins upon receipt of the last item.

2. A dedicated online withdrawal function is available for declaring the withdrawal, which can be accessed throughout the entire withdrawal period. Alternatively, the model withdrawal form provided there can be used, or the withdrawal can be declared informally by e-mail, telephone, or post.

3. All details regarding deadlines, refunds, returns, loss of value, and exceptions are contained in the Withdrawal Policy. It is an integral part of these GTC.

VI. Prices

1. All prices are total prices. They include packaging costs as well as statutory VAT and alcohol tax.

2. Shipping costs are not included and are charged additionally. They will be indicated before the order is placed.

3. Price errors remain reserved. If the correct price is higher, Gölles GmbH will contact the customer. In this case, a contract is only concluded if the customer wishes to purchase at the correct price. If the correct price is lower, the lower price will be charged.

VII. Shipping Costs

1. For delivery within Austria and to Germany, shipping costs amount to 8.90 euros per order, including VAT.

2. From a gross order value of 100.00 euros, shipping costs are waived in both countries.

VIII. Delivery

1. Delivery takes place to the address provided by the customer.

2. Deliveries are made to Austria and Germany.

3. The delivery time is 2 to 3 working days to Austria and 4 to 5 working days to Germany. In the case of agreed advance payment, the period begins at the time of the payment instruction. No deliveries are made on Sundays and public holidays.

4. Gölles GmbH is not liable for delivery obstacles within the sphere of suppliers or manufacturers. If delivery or compliance with an agreed delivery time becomes impossible due to circumstances for which Gölles GmbH is not responsible, it is entitled to withdraw from the contract in whole or in part. The customer will be informed immediately; payments already made will be refunded. Existing delivery restrictions will be communicated before the start of the ordering process.

IX. Minimum Age

1. Alcoholic beverages are sold exclusively to persons who have reached the age of 18. By placing an order, the customer confirms that they have reached this age.

2. Gölles GmbH reserves the right to request proof of age in case of doubt and to withhold delivery until it is provided.

3. The requirements of German youth protection law apply to deliveries to Germany.

X. Due Date and Retention of Title

1. The purchase price is due at the latest upon delivery of the goods.

2. The delivered goods remain the property of Gölles GmbH until full payment has been received.

XI. Terms of Payment

1. The following payment methods are offered: Credit and debit card via Shopify Payments, PayPal, Klarna, and Apple Pay.

2. Statutory default regulations apply. Reminder fees may be charged from the second reminder onwards.

XII. Warranty

1. Statutory warranty provisions apply.

2. The warranty does not cover defects resulting from improper handling or storage by the customer, in particular storage under direct sunlight or at unsuitable temperatures.

3. If delivered goods show an obvious defect or transport damage, we ask for prompt notification so that we can find a solution. Statutory warranty rights remain unaffected and do not depend on such notification.

XIII. Liability

1. Claims for damages against Gölles GmbH are excluded unless Gölles GmbH or its vicarious agents have acted with intent or gross negligence.

2. This does not affect liability for damages resulting from injury to life, limb, or health, liability under the Product Liability Act, and liability for the breach of essential contractual obligations. Essential contractual obligations are obligations whose fulfillment is required for the proper execution of the contract and on whose compliance the customer may rely.

XIV. Set-off and Retention

1. The customer may set off against claims of Gölles GmbH if their counterclaim has been legally established or recognized by Gölles GmbH, if it is in a legal relationship with their obligation, or if Gölles GmbH is insolvent.

2. The customer may only exercise a right of retention if their counterclaim is based on the same contractual relationship.

XVI. Copyright

All images, films, and texts published on goelles.at are protected by copyright. Any use without the express consent of Gölles GmbH is not permitted.

XVII. Applicable Law, Place of Performance, Place of Jurisdiction

1. Austrian law applies, excluding the UN Sales Convention. Mandatory consumer protection provisions of the state in which the consumer has their habitual abode remain unaffected. For consumers with habitual abode in Germany, this means in particular that the protection of German consumer law remains intact.

2. The place of performance is Riegersburg.

3. For lawsuits against consumers, the court of the consumer's place of residence, habitual abode, or place of employment has exclusive jurisdiction. Consumers may choose to sue Gölles GmbH either at its registered office or at their own place of residence.

XVIII. Dispute Resolution

Gölles GmbH is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board. In case of complaints, please contact us directly; we will generally find a solution.

XIX. Final Provisions

1. Should any provision of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.

2. The version of these GTC available on goelles.at at the time of the order is authoritative.
